COMMERCIAL CIRCULAR NO. 81 OF 2012

Subject: Awarding of contracts on media space for advertisement to various
Ministries/Departments/ Public Sector undertakings under Central
and State Governments

Comprehensive guidelines exist with Zonal Railway for generating revenues
through commercial publicity by utilizing various assets of Railways such as Stations,
Passenger trains, level crossings, goods trains and websites. These guidelines provide
for awarding of Commercial Publicity contracts through open Tender.

2 Proposals are being received from various Ministries/Departments/Public.
Sector undertakings under Central and State Governments seeking media space for
advertisement of their various flag ship programmes. It is understood that the
PSUs/Departments have substantial budget allotment for Publicity. However, the
cumbersome and time-consuming procedure involved in the Tender process has been a
discouraging factor for the Government Departments and PSUs hiring the media/space
utilization with Indian Railways.

3, In keeping with the interests of Railways, it has been decided to offer media
space for advertisements to Ministries/Departments/Public Sector Undertakings of
Central and State Governments on a separate footings as per the conditions laid down
below:

a. Ministries/Departments/Public Sector Undertakings of  Central/State
Governments may be offered such media space for advertisements on
contract basis without participating in the Open Tender, the open tender for ~
which has failed at least twice in the immediate past.

b, For advertisement on existing space/media which has not been tendered in the
past and also for spaces/media newly created for which
Ministry/Departments/Public Sector Undertakings of Central/State
Governments have evinced interest, the reserve price may be fixed in
consultation with Finance (in terms of Commercial Circular No. 70 of 2012)
The price so fixed may be inflated by 5% as premium over the Reserve price

c. and offered to Ministries/Departments for advertisements on contract basis
without participating in the Open Tender.
d. The contract period shall be for a maximum period of 5 years with
enhancement in the license fee uniformly by 10% for every year from second

year onwards.

e. The schedule of powers in awarding such contract shall be as stipulated in the
Commercial Circular No. 74 of 2007.
