GOVERNMENT OF INDIA MINISTRY OF RAILWAYS (RAILWAY BOARD) No.2008/TG-I11/462/03 New Delhi, dated : 22.01.09 re The General Managers, All Indian Railways. | COMMERCIAL CIRCULAR NO. Y of 2009 (Clarification to Commil.Cir.No.88 of 2006) Sub: Eligibitity criteria for allotment of bookstalls at the railway stations _ to the philanthropic and social organizations ~ clarification thereof . Ref: Board’s letter No.2000/FG-I11/464/18/Policy dated 18.10.2006. _ Instructions have been issued to zonal railways for allotment of beokstalls at the railway stations - to the philanthropic and social organizations vide Board’s letter dated 18.10.2006 mentioned above. However, some zonal railways have sought clarification regarding the eligibility criter of philanthropic and social organizations for allotment of bookstall. Board have approved the following -¢riteria for identification of philanthropic and social organizations for the purpose of allotment of - bookstalls :- लि ः . . @ wi The philanthropic and social organizations must. have their own publication of books and periodicals for promoting social.and cultural values of the society. Such organization should be registered as Society or Trust or Company i.e. Society registered under Societies Registration Act, 1860; or (ii) Trust formed under Trust deed or registered with - पर ः oes Income Tax Authority; or (iii) Limited Company incorporated for charitable purposes under दी section 25 of the Companies Act, 1956 and in support to their such claim they should submit - their registration certificate while applying to railways. . ' ः The application of such organisations to Zonal Railways ‘for allotment of bookstalls under the category of philanthropic and social organization should be accompanied: with the following - certificates in addition to the above : दर दर SS a) Certificate of registration of organization with Income Tax Deptt. regarding its registration under section 12(A) of Income Tax Act, 1961; and b) Gazette Notification (for Section 35AC) or Exemption Certificate (for Section _ 800) from the Income Tax Deptt. such that that the donations made to the organization are exempted under either Section 35AC or 80G of Income Tax Act,.1961 or both. नि "6 above registration/exemption certificates should be valid during the tenure of the licence. _ Copy to : MDAIRCTC, New Delhi for information.
