Sub:- Allotment of bookstalls to philanthropic and social organizations

Please rofer to Board's letter of even no. dated: 11.11.2005 followed by
clarifications dated: 16.12.05 wherein zonal railways were advised that a status quo
should be maintained and no temporary extension should be granted in view of the SLP
filed egainst the orders of Hon'ble High Court of Allahabad in respect of Bookstall
Policy of Oct 2004 in the Hon'ble Supreme Court of India. Also railways have been
asked to hold up the process of awarding new bookstall licences til! further orders.

Ministry of Railways have considered the issue of allotment of new bookstalls to
Philanthropic and social organizations and the following guidelines are isgued--

a} New bookstalls to philanthropic and social organizations may be allotted
based on requirement a5 per the extant policy by inviting applications

b) Allotment of bookstalls to the philanthropic and social organization may
be considered at all stations including banned stations as notified vide
Board's letter No. 87/TG.01/639/12 dated 27.3.87, with the approval of
the General Manager of the concerned railways.

¢) The allotments would be without any prejudice and would be subject to
the outcome of the SLP No C - 12096-2005 - UJOI Vs Mis A. H.
Whoeler & Co. converted to Appeal Civil 2919 of 2006.

@) Allotment of these stalls should not cause congestion and obstruction to
the free movement of the passengers.

¢) initial allotment will be for a period of five years and the renewal will be
subject to the outcome of the SLP referred above.
