General Conditions of Contract –
Important clauses

Introduction
•
IR General Conditions of Contract (GCC) form an integrated part
of the Works tenders and contracts. This set of conditions/
clauses cover all the important stages during the execution of a
particular contract right from invitation of tenders, finalisation of
tenders, till conclusion of contract. Railway Board is the apex
authority for issue of this GCC, amended from time to time, as per
experiences gained and based on the feed back received from
Zonal Railways. Currently, GCC- April 2022 is in vogue. Whenever
any new GCC edition is released or any correction slip is issued,
the same will apply with prospective effect. Board has
incorporated almost of all the conditions/ clauses in the GCC, as
earlier some of the conditions use to appear as Special conditions
of contract.

The Instructions to Tenderers shall be read in conjunction with
the  General Conditions of Contract and shall be subject to
modifications additions or suppression by Special Conditions of
Contract and/or Special Specifications, if any, annexed to the
Tender Forms.

•
Order of Precedence of Documents: In a contract agreement, in case of any
difference, contradiction, discrepancy, with regard to conditions of tender/contract,
specifications, drawings, Bill(s) of Quantities etc., forming part of the tender/
contract, the following shall be the order of precedence:
•
Letter of Award/Acceptance(LOA)
•
Bill(s) of Quantities
•
Special Conditions of Contract
•
Technical Specifications as given in tender documents
•
Drawings
•
Indian Railways Standard General Conditions of Contract updated with correction
slips issued up to date of inviting tender or as otherwise specified in the tender
documents.
•
Indian Railways Unified Standard Specification (IRUSS-2019) updated with
correction slips issued up to date of inviting tender or as otherwise specified in the
tender documents, if applicable in the contract.
•
Indian Railways Unified Standard Specifications (Works and Material) 2010 updated
with correction slips issued up to date of inviting tender or as otherwise specified in
the tender documents, if applicable in the contract.

6. Care in Submission of Tenders:
•
Before submitting a tender, the tenderer will
be deemed to have satisfied himself by actual
inspection of the site and locality of the works,
that all conditions liable to be encountered
during the execution of the works are taken into
account and that the rates he enters in the tender
forms are adequate and all inclusive to accord
with the provisions in Clause-37 of the Standard
General Conditions of Contract for the
completion of works to the entire satisfaction of
the Engineer

Open tenders -  Two packet system of tendering
• 7A. Two Packets System of Tendering: With a view to assess the
tenders technically without being influenced by the financial
bids, 'Two Packets System of tendering' shall be adopted
wherein tender documents provide for the same.
• As per current delegation of powers, For inviting Works
Tenders valuing more than Rs.10 Crs, two-packet system, shall
mandatorily be followed.
• For Tenders valuing beyond the tender acceptance powers of
SAG/DRM/ADRM/CWM, and costing more than Rs 10 Crore,
decision of executive not below HAG in consultation with FA&
CAO shall be required to adopt Single packet system of
tendering in case of works tenders. Authority (RB ltr no 2017/
Trans/01/Policy dated 26-12-2017)
• For Tenders valuing up to Rs. 10 Crs, decision to adopt two-
packet system shall be taken by the tender inviting authority
with the concurrence of associate finance

10. Eligibility criteria
• Eligibility criteria need not be stipulated for open
tenders up to Rs.50 lakhs each. For relaxation in
the prescribed eligibility for open tenders costing
above Rs.50 lakhs, personal approval of GM is
required with PFA’s concurrence in case of Open
