No. 11 - 11///008/2009/ Vol. - Il J20 Dated: 22 April, 2014 ADVISORY — 02/14 Sub: Guidelines in respect of booking of animals and birds (wild or otherwise) by Indian Railways - reg Depletion of wild flora and fauna is matter of grave national concern. This depletion is due. to various factors but the organized trans — border illegal trade in wildlife and its parts/products is the most potent threat that can wipe out the population of any species within short period. Wildlife poached in hinterland is transported to urban destinations; and also to international borders to be further smuggled out of the country, by various means and modes. Inputs indicate that trains are being used regularly by the criminals to illegally transport wildlife especially birds, turtles and marine species, to various destinations within the country. To avoid detection, prohibited species of birds are often mixed with live poultry, and turtles/ tortoises and marine species with fish consignments. > 2. Section 48 A, of the Wild Life Protection Act, 1972, restricts transportation of wild life and - specifies - “No person:shall accept any wild animal (other than vermin), or any specified plant or part or derivative thereof, for transportation except after exercising due care to ascertain that permission from the Chief Wild Life Warden or any other officer authorized by the State Government in this behalf has been obtained for such transportation”. Any violation of the provision is punishable under Section 51 of the Act. For such violations, every person who, at the time of offence, was in charge of and was responsible for conduct of the business will be deemed guilty of offence and liable for criminal prosecution (Section 58 of the Act). 3 To ensure wild animals and birds are not booked for transportation by rail, the Railway Board, Ministry of Railways, Government of India, has issued guidelines to its field formations. The guidelines interalia specify no consignment of birds (wild or otherwise) and wild animals should be accepted for transportation unless a certificate is issued from the authorized officer i.e. Chief Wildlife Wardens, District Animal Husbandary officers etc. Copy of the guidelines dated 1 7” May 2013, is enclosed herewith at Appendix. rh 4.
