Hon’ble Supreme Court in WP(Civil) No.400of 2012 with 604 of 2013 titled as National Legal services Authority Vs. UOI & Others has inter-alia directed that Hijras, Eunuchs, apart from binary gender, be treated as “third gender” for the purpose of safeguarding their rights under Part पा of our constitution and the laws made by the Parliament and the State Legislature. It has, therefore, been decided to include the third gender/transgender option alongside male/female in reservation/cancellation requisition form. This information will be captured by the system and tickets to transgender will be issued on full fare. 2. Further, instructions have been issued dated 29.09.2016 (Commercial Circular No.52 of 2016), wherein S.No.38 of IRCA Coaching Tariff No.26, Part-I (Vol.ID regarding concession to senior citizen in rail fare has been revised as under: “A senior citizen of Indian Nationality, permanently residing in India of the age of 60 years and above for Men Senior citizen and 58 years and above in case for Women Senior citizen shall only be eligible for concession in passenger fare.” 2.1 Further, the following has been added below Para No.19 of Rule No.101, Chapter lof IRCA Coaching Tariff No.26 Part-I (१०.1): “However, Senior Citizen Concession shall not be admissible to the senior citizen of foreign nationals & NRIs” 3. Accordingly, the reservation/cancellation requisition form has been revised and a copy of the same is enclosed. CRIS will make necessary modifications in the software wherever required and advise the date of effect to all Zonal Railways as well as this office.
