Sub: Senior Scale Promotion to Railway doctors in case of delay in confirmation on account of proceeding on sanctioned EOL- Clarification regarding.

In terms of Board's letter No. E(O)III-2004/AE/280 dated 11.05.2005 the sanctioned EOL period of IRMS officers for prosecuting higher studies is counted as qualifying service for promotion, pension and increments.

Instructions contained in Board's letter No. 99E(GR)IIf7/48 dated 08.12.1999 also stipulate that no ADMO be considered for promotion to higher grade of DMO unless he is confirmed in the entry grade of ADMOs.

A clarification was also issued vide Board's letter No. E(O)III-2005/AE/436 dated 02.07.2008 wherein it was clarified that wherever the Railway Medical officers become due for promotion to Senior Scale under DACP Scheme on completion of four years service in Junior Scale when they are still on sanctioned EOL for pursuing higher studies, the benefit of promotion should be allowed to them only on their return to duty after EOL and on their assuming charge of the higher grade post and no proforma promotions be allowed to them with effect from the date on which they complete the stipulated four years service in Junior scale. They will be eligible for further promotion under the Scheme only when they complete the stipulated minimum years of service in the lower grade based on their actual promotion, subject to fulfillment of other eligibility conditions.

Further to the above, the issue of reckoning the date of promotion to Senior Scale in cases where a Railway doctor proceeds on sanctioned EOL (for higher studies) without completing his probation period and then after availing his sanctioned EOL joins back and completes his remaining probation period leading to delay in his confirmation as ADMO, has been examined in Board's office. In this connection it has been observed that some Railways have granted Sr. Scale promotion to such doctors only after the date they are confirmed as ADMOs which, in many cases happened to be beyond the date of completion of 4 years of service or date of returning from sanctioned EOL. This has resulted in late promotion of such doctors in every subsequent promotion to higher grade.

The matter has been examined in detail in consultation with Associate Finance and its clarified that wherever an IRMS probationer is sanctioned EOl for prosecuting higher studies and his confirmation as ADMO is delayed on account of delayed completion of his probation due to his proceeding on sanctioned EOl, while he will be considered for promotion as DMO only on his confirmation after successful completion of probation, on being found fit for promotion, the same will be granted retrospectively from the date he completed 4 years of regular service in Junior Scale or the date on which he returned to duty after the sanctioned EOl, whichever is later.
