Can any reserved candidate (who have been appointed as reserved) SC/ST be treated as unreserved or utilize unreserved point in promotion by non- selection procedure? Example in carder of 100 staff there are already 20 SC and 10 ST candidates, now if candidates from a lower post are to be promoted to this above mentioned post, and there are 20 vacancies all of which belong to Unreserved category : if the senior most 10 staff in seniority list from which carder the promotion are to be made are from the reserved category that is SC/ST (which already are excess) Can those reserved candidates utilize Unreserved points/posts? Under what circumstances can reserved candidates (SC/ST) utilize unreserved (UR) posts Please provide DoPT circular/guidelines and Railway Board circular/guideline copy.

Can Reserved candidates be promoted in excess of their reserved posts in the carder after the implementation of RB 113/97 RB 114/97? If yes please provide DoPT circular/orders copy If yes please provide Railway board circular/orders copy. How will the seniority of such reserved candidates who have been promoted beyond their quota be treated? From which date? Date of promotion? Or Date of actual vacancy in the carder?
