Sub: Methodology for calculation o£ non-working hours in congested goods sheds.

Ref: Rates Circular No.12 of 2011

. A clarification has been sought that in the case of congested goods shed having working hours 06.00 to.22.00, if free time expires at or before 22.00 Hours, whether time during 22.00 to 06.00 will be taken into consideration while reckoning total time taken by indentor/consignor for loading, for the purpose of forfeiture of Wagon Registration Fee and cancellation of indent, as per the guidelines prescribed vide Rates Circular No.12 of 2011.

As per extant guidelines, in case of goods shed having working hours 06.00

to 22.00, if free time expires at or before 22.00 Hours, Demurrage rule is applicable for detention of the rake during 22.00 to 06.00 hours. Thus, if free time expires at or before 22.00 Hours, detention during 22.00 to 06.00 is treated as excess detention for the purpose of levying Demurrage Charge. In the same way, in the case of congested goods shed having working hours 06.00-22.00 hrs, if free time expires at or before 22.00 hrs, the time between 22.00 hrs to 06.00 hrs is to be taken into consideration while reckoning total time taken by indentor/consignor for loading, lor the purpose of forfeiture of Wagon Registration Fee and cancellation of indent.
