As per sub-rule 138(2) of notification 27/2017 (further amended vide CBEC notification 3/2018), “Provided that where the goods are transported by railways or by air or vessel, the e-way bill shall be generated by the registered person, being the supplier or the recipient, who shall furnish, on the common portal, the-

a. information in Part B of FORM GST EWB-01; and

b. the serial number and date of the Railway Receipt or the Air Consignment Note or Bill of Lading, as the case may be”.

The responsibility to generate E-way Bill online as per the extant rules shall thus rest — with the registered person as supplier or recipient; i.e. as consignor or consignee.

Board has made a representation to CBEC seeking certain modifications in the other extant E-Way Bill Rules. Till such time that a decision in this regard is received from Ministry of Finance (CBEC), the following guidelines may be adhered to:

a) Board has decided that an undertaking shall be obtained from each consignor on the Forwarding Note before accepting goods for Loading/Transportation as per Annexure A. Zonal Railway shall take necessary action to ensure the same in case of manual Forwarding Notes also. CRIS may modify the Forwarding Note format suitably in the system in case of online demand registration.

b) The consignor/Consignee shall generate the E-way using the FNR number as Transport Document Number, instead of RR number. Consignor shall provide the E-way bill number to goods clerk, who shall enter the same in records. Detail procedure is as given in Annexure B.

These guidelines shall come into force w.e.f. 01.02.2018 and shall remain in force till further advice.
