Levy of Detention Charge for load adjustment of overloaded wagon case of a private siding where rake was released before expiry of free time, it was weighed at
a Government of India (भारत सरकार) Ministry of Railways (tet Barer) (Railway Board रेलवे बोर्ड) No.TC-I/2014/108/4 New Delhi,Dt. 27.08.2017 Chief Commercial Manager SWR, Hubli Sub: Levy of Detention Charge for load adjustment of overloaded wagon. Ref: SWR’s letter No.C.613/Weighbridges Vol.X dt.21.07.2017 Please refer to SWR’s letter under reference wherein Railway has mentioned about a case of a private siding where rake was released before expiry of free time, it was weighed at the weighbridge inside the siding premises, overloading was detected after weighment and load adjustment was carried out within stipulated free time. Railway has sought clarification whether Detention Charge for load adjustment is leviable in this case. It is to state that permissible free time is the upper limit for completion of loading/unloading activity. It implies that ‘Free time’ will lapse as soon as the wagon/rake is released after completion of loading/unloading operation. Release of wagon/rake is followed by weighment. For wagons found overloaded after weighment, the guidelines for levy of Detention Charge etc. are prescribed vide Para 4.3 of RMC/Provision of Weighbridge/2014/0 dt.11.07.2014, which are self explanatory.
