Sub: Joint Procedure Order For Refund Of Wharfage/Demurrage Charges

It has been brought to the notice of this office that the procedures for refund of Wharfage/ Demurrage charges are not being followed by the divisions as per the ARN under reference. It is also_ observed that the pay orders are being issued without being routed ही through Traffic Accounts Office. The same has heen viewed seriously by the Competent Authority. The instructions issued vide the above ARN is reiterated for strict observance and guidance of the staff so that care is . taken to ensure that the refund claim is being preferred by Consignee/ Consignor/ Endorsee.

1. As per earlier Board’s policy No. TC-I/2001/201/5 dated

02.01.02, it was not compulsory to deposit the demurrage/ wharfage charges at the time of first application and the parties were depositing wharfage /demurrage amount only after the appeals were finalized by the competent authority.

Thus refund cases were negligible.

This created the need to issue JPO between Accounts and Commercial department so that the work of refund of demurrage/wharfage charges could be streamlined.

. After the final waiver has been granted by the Competent

Authority, the accountal of the remittance has to be got verified through in-charge of the unit. CGC/CPS of concerned station and TIA where it has to be proved and thereafter the concerned Sr. DCM/DCM can send the Pay Order to Dy. CAO(TA)-Ajmer along with documents i.e.:

Demurrage / Wharfage statements Party’s application/ appeal for waiver MR in original

Waiver authority in original

These documents are required to be submitted to accounts once in 10 days through courier and Accounts Office nominates 4 supervisor who will give acknowledgement of the documents received.

, On receipt of case along with the above documents and the Pay

Order, Dy. CAO (TA)- Ajmer gets the remittance verified and conduct internal checking from their record and issue the cheque to the concerned party.

. The particulars of issue of cheque/payment authority by

Accounts Office is advised to the concerned Sr. DCM/ DCM so that the same is kept on record and in case of any further query by the party concerned reply can be given to party.

While granting waiver, the competent authority ensures that all

the provisions contained in Railway Board's letter No. TC-

1/2004/ 201/9 dated 11.10.2004 is followed.

The competent authority while considering the application/ appeal should ensure the accountal of the demurrage /wharfage amount by verifying that the original MR is attached with the appeal application.
