Ref: 1) Railway Board's letter No, PC-V1/2020/CC/13 dated 03.12.2024 2)This office letter No. CR-HQOPERS(PUMR)/13/2023 dated 11.12.2024, meine Vide APO (Ruling)'s letter under reference No. 2, Railway Board's letter dated 03.12.2024 has been circulated. Board vide the said letter has circulated the DOPTs OM dated 14.10.2024 for information and compliance and has advised that the instructions shall apply mutatis mutandis on the Railways also. In Para 7 of DOPT’s OM dated 14.10.2024 circulated vide Railway Board's letter under reference No. 1, it is advised that in pursuance of the Order dated 06.09.2024 of the Hon'ble Supreme Court referred above, action may be taken to allow the increment on ist July/1st January to the Central Government employees who retired/are retiring ‘a day before it became due i.e. on 30th June /31st December and have rendered the requisite qualifying service as on the date of their superannuation with satisfactory work and good conduct for calculating the pension admissible to them. As specifically mentioned in the Orders of Hon'ble Supreme Court, grant of the notional increment on Ist January/1st July shall be reckoned only for the purpose of calculating pension the pension admissible and not for the purpose of calculation of other pensionary benefits, Since a number of court cases have been filed and decided on the subject issue directing edministration to grant the benefit of notional increment to the applicants, the issue was examined through legal cell of this office and Competent Authority has directed that all Divisions ‘and Units should take urgent necessary steps as under in compliance of DOPT's OM dated 14.10.2024 circulated vide Railway Board's letter under reference No. 1 : @ i) To grant notional benefit to the retired employees who have filed court cases before Court and Order has been granted in their favour ‘as per the order of respective courts. ii) To grant the benefit of notional increment in case of third parties as per Railway Board's letter dated 03.12.2024, that is, the pension by faking into account one increment will be payable on and after 01.08.2023. Enhanced pension for the period prior to 31.04.2023 will not be paid. iti) (Grant of notional inerement shall be reckoned only for the purpose of calculating pension admissible and not for the purpose of calculation of other pensionary benefits. iv) Hence, instructions already circulated vide Railway Board's letter dated 03.12.2024 needs to be implemented /complied in true sense.
