A AIOBCREA/CR vide Ref (1) had questioned the validity of the clarification given by CR
regarding applicability of reservation to the upgraded posts in PML-8 & PML-9 vide Ref (2).

2. A meeting of all Zonal Railways with Railway Board to discuss Reservation policy was held on
20" & 22"' March, 2024. This matter was raised by Zonal Railways in this meeting. Railway Board vide
Ref (3) has clarified this position of Rule as follows.

It was clarified that the Rules position in this regard is very clear that in case of mass
upgradation where all the posts in a cadre is upgraded without corresponding
increase in cadre strength reservation will not be applicable.

Whereas, in case of partial upgradation where certain portion of the particular
cadre is upgraded to new post with corresponding increase in the cadre strength,
reservation will be applicable on this parted upgraded cadre as well as on the non-
upgraded strength of the said cadre.

3. The issue raised by the Association vide Ref (1) is clarified by Railway Board. As per this
clarification the instructions issued by CR vide Ref (2) is legal and confirming to the provisions of
Reservation in promotion.
