Sub: Defending Claim cases in Railways Claims Tribunal - reg.

Ref:- (i) Board's letter No. 89/TC(RCT)/4-7(Pt.) dated 28.09.1990 regarding duties of
Presenting Officers.
(ii) Board's letter No. 89/TC(RCT)/4-7(Pt.) dated 28.09.1990 regarding presentation

of Railways cases in Railway Claims Tribunal.

As per extant procedure, application for compensation payable under Section 124
or 124-A of the Railways Act, 1989 may be filed before the Bench having territorial
jurisdiction over the place where the train accident or untoward incident occurs; OR where
the claimant normally resides. In cases, where claimant files claim in RCT bench nearest to
his/her residence, the bench may be situated outside the Zonal Railway where the
accident/incident occurred (which is also the Respondent in such cases).

2. It has come to notice of the Board that in the Claims cases which are filed outside
the concerned Zonal Railway/s (which is respondent Railway), the concerned Zonal
Railway/s are not adequately dealing the case which weakens the position of the
respondent railway in the case and which may also lead to payment by way of
compensation. These cases, therefore, require close monitoring by Zones and Divisions.

3. The matter needs to be dealt with alacrity and all out efforts may be made to
ensure strict compliance of the following:~

(i) Timely nomination of the Advocate/Counsels for defending the cases,

(ii) Timely submission of all the necessary documents i.e. DRM report, Written
Statement and other necessary papers are filed in concerned RCT bench,

(iii) Take Briefings with the nominated counsel/s before the date of
hearing,

(iv) Appearance of the counsel on the date of hearing of the case, and other
necessary action as deemed suitable,

(v) All Presenting Officers (POs) may be sensitized about the efficient monitoring
and coordination of all the cases filed in their concerned RCT benches.

(vi) CCOs should often visit the RCT benches located at their Headquarters and
other benches within their jurisdiction.

(vii) CCOs should take monthly review of the pending RCT cases with POs under

their control.

4, — It is reiterated here that instructions regarding duties of POs have been issued

comply with the instructions contained in the aforementioned letters.
