Sub: Corrigendum to ‘Policy’ and ‘Standard Conditions of Contract’ for Commercial Earning and NFR Contracts awarded through e-Auction. Ref: FM Circular No. 11 of 2022, issued vide Board’s letter no. 2022/TC(FM)/10/04, dated 13.06.2022. Certain Clarifications have been sought by Zonal Railways w.r.t. guidelines issued for ‘Policy’ and ‘Standard Conditions of Contract’ for Commercial Earning and NFR contracts, awarded through e-Auction. I. After careful consideration, Competent Authority have now approved following modifications in the Policy for integrated Parking Contracts having high investments awarded through e-Auction. (i) Para 19.3 is added as under- “Division is empowered for providing relaxation in the time period for payment of license fee even after lapse of grace period with detailed justification and personal approval of DRM. This may be done however for a period of 2 weeks i.e. 1 week @ 0.75% penalty and another 1 week @1% vena!ty so that there is incentive to pay the amount within stipulated period. (It may be noted that provision of 0.5% penalty is already there for payment within grace period of 7 days)”. (ii) Para 21.2 is added as under:- “Division is empowered to modify the CP start date upto 1 month with detailed justification and personal approval of DRM. Also, divisions must ensure that all major conditions precedent be satisfied before the auction of an asset is carried out.” II.
