Role of RPF in Ticket Checking, Therefore, RPF Staff shall not do any ticket checking of Passengers on their own.

Indian Railway Commercial Manual authorises only Ticket Checking staff to do ticket checking, Section 535 of the Manual explains that ‘intent to defraud’ is an essential ingredient of offence u/s 137 of the Railways Act. Ticket Collector or Travelling Ticket Examiner may deal with cases of passengers travelling without ticket u/s 137 only when there are elements in the facts of any case which indicate the intent to defraud. 2. Section 179 (2) of the Railways Act authorises officers, of and above the rank of Assistant Sub-Inspector, in RPF to arrest offenders of sections 137 and 138 without warrant or other written authority and section 180A gives authority to make an enquiry for ascertaining facts and circumstances of the offence. 3. Therefore, provisions of the Railways Act read with the Indian Railway Commercial Manual make it clear that ticket checking and levy of excess charge are to be done only by Ticket Checking Staff and intent to defraud has to be ascertained by them. RPF Officers, of and above the rank of ASI, may arrest u/s 137 and 138 of the Railways Act only when an offender is handed over to them with due justification by the ticket checking Staff. Therefore, RPF Staff shall not do any ticket checking of Passengers on their own. 4. RPF personnel shall not be involved in Ticket Checking drives and chasing passengers for this purpose on moving trains and on platforms as it may Fe ate panic amongst passengers leading to serious incidents.
