Sub: Procedure for handiing of persons who are under 18 years of Al present, a person who has been tound involved in any activity in COnct or law, Is taken up as per the provSIons ot Indian Kailway Act, 198 iTespective of the age ol the person.

Aerala State Commission for protection of child rights vide

- CRMP No. 850111/1LAZ/KeSCPCR dated 31.12.2016 has issued the following directions:- iEither as per Railway Authority or any other Authority if found a person below the age of eighteeri has committed a wrong then either the Railway Police or Iicket Checking authorities should not collect any fine trom such minors If the Railway Authorities are required to inittate action against the minor tor the wrong. i1 any, then the proper proceeding is to submit a report betore the Juvenile Justice Board enacted as per Section- of the Juveniie Justice (Care & Protection of Children) Act. 2015 On the other hand, the are not supposed to submit and report or physically present these juv eniles betore the Railway magistrates.
