Sub: Amendment to section 179 and 180 of the Railways Act, 1989 and notification for the officers authorized under these Acts.

A Bill to amend sections 179 and 180 of the Railways Act 1989 had recently been passed by the Parliament wherein the words ‘any railway servant authorized in this behalf or any police officer not below the rank of Head Constable” has been substituted with ‘Officer Authorised’. A Gazette notification to this effect has already been issued by Ministry of Law and Justice on 23.12.03. A notification defining the Officer Authorized as ‘All the officers of and above the rank of Assistant Sab- Inspector in Railway Protection Force’ and appointing 1.7.2004 as the date on which the said Act would come into force, has also been issued by the Ministry of Raltways on 17.05.04

2. The matter has been reviewed and it has been further decided to,authorize, .

the Officer, not below the rank of a Group C Officer of the Commercial Department, the Operating Department or the Vigilance Department in the Ministry of Railways as

the ‘Officer Authorised ' for the purpose of section 179 of the said Act.

A copy of ‘Gazette Notification’ dated 2.8.04 to this effect, issued by Ministry of Railways, Railway Board is endosed for implementation

का.आ. 874 अ ).--रेल अधिनियम, 1989 (1989 का 24 ) की धारा 179 की उप-धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतदद्वारा डल्लिखित अधिनियम की धारा 179 के प्रयोजनों के लिए '* अधिकृत अधिकारियों '' के रूप में रेल मंत्रालय के वाणिज्य विभाग, परिचालन विभाग या सतर्कता विभाग के समूह 'ग' अधिकारी के ओहदे तथा उससे उच्चतर ओहदे के अधिकारियों को अधिकृत करती है । .

S.O. 874(E).—In exercise of the powers conferred by Sub-section (2) of Section 179 of the Railways Act, 1989 (24 of 1989), the Central Government hereby authorises the officer not below the rank of a Group ‘C’ officer of the Commercial Department, the Operating Department or Vigilance Department in the Ministry of Railways as the “officer authorised” for the purposes of Section 179 of the said Act.
