Sub: Policy circular on Private Siding: Marketing Circular No. 11 of 2016 ~ contradicting provisions for Inspection Charges of Civil Engineering assets in existing private siding outside the Railway boundary

One of the Zonal Railways; referring Para 9.4 of Freight Marketing Circular No. 11 of 2016 (Policy on Private Sidings) and Paras 8 (b) (i) and 8(c) of Private Siding Agreement, has highlighted the issue regarding contradicting provisions for Inspection Charges of Civil Engineering assets in existing private siding outside the Railway boundary. |

The issue has been examined in detail in Board office and it is clarified as under:

(i) Ifthe siding maintenance is done by the siding owners themselves at their own cost, Railway shail levy Inspection Charges only as per details in Annexure-4Y.

(ii) If the siding maintenance is done by the Railways at the cost of siding owners, Railway shall levy Maintenance Charges only as per details in Annexure-4X

This issues in consultation with Freight Marketing Directorate of Ministry of Railways. .

As per the extant orders, maintenance and repair charges for private siding, wherever these are maintained by the Railways, are levied on km basis as per the guidelines indicated in letters under reference.

These instructions have now become quite old, while recommendations of 6™ Pay Commission have already been effected. The matter has accordingly been considered in depth and the Board have decided that in supersession to all previous instructions on the subject, Maintenance & Repair Charges alongwith Inspection Charges for one track km of the Private Siding shall consist of the following :

(a) Staff Cost :

i) Average Pay of staff ii) Dearness Allowance payable to staff iii) Leave Salary © 11% of (Pay + DA) of staff iv) PF. & Gratuity @ 1/8 of (Pay + 1/11 of Pay) of staff

v) Incidental Charges 10% of (Pay + 1/11 of Pay) of staff vi) House Rent Allowance to be added, at the rates as applicable

(b) Tools and Plant Cost Rs. 10,000 per year .

(c) Cost of replacement of small fittings etc. © 3% per year of cost of new fittings

(d) Departmental charges on (a+b +c) @124% of the above cost

(a) Staff required for Maintenance of 1 track km of siding per month shall be taken to be as under :

(ie. 4 Trofleymen for (i.e. one man for one one month ina year) month ina year)

(b) Staff required for Inspection of 1 track km of siding per month shall be taken

to be as under :

(i) SSE/P.Way : ° 1/10km / 25 days (0,004)

(ii) Trotleymen (Now T.M. Gr.IV - IZ) : 4/10 Km / 25 days (0.016)

Where the siding contains points & crossings, ten sets of points & crossings shall be taken as equivalent to one km. In calculating one set of points & crossings, the

following formula shall be followed :
