(Amendment No. 04 to FM Circular No. 11 of 2022) Sub: Amendment to the Policy for ‘Commercial Earning and NFR Contracts’ awarded through e-Auctions. Ref: FM Circular No. 11 of 2022, issued vide Board’s letter of even no. dated 13.06.2022. न न के के के के मे ‘Policy’ and ‘Standard Conditions of Contract’ for Commercial Earning and NFR contracts awarded through e-Auctions, were issued vide Railway Board’s FM Circular No. 11 of 2022. 2. In this regard, suggestions have been received from Railways to allow ‘leasing of Parcel Vans by destination Railway also’, and ‘leasing of parcel space of SLRs from intermediate station’. 3. The matter has been deliberated upon, and the Competent Authority has approved following modifications in the FM Circular No. 11 of 2022 (i.e. Policy for Commercial Earning and NFR Contracts awarded through e-Auctions): Para 20.2 is modified as under — Normally, leasing of Parcel Vans should be done on round trip basis by the owning Railway of the train, on end-to-end basis. However, if the owning railway fails to lease out Parcel Van through e-Auction, only then the Zonal Railway of the other-end/destination-end may lease out Parcel Vans on round trip basis, with the prior consent and obtaining operational clearance (NOC) from the owning Railway. New Para 20.5 is added as under — 20.5 Leasing of parcel space of SLRs from Intermediate stations:. 20.5.1 Parcel space of the SLRs of Passenger-carrying trains should normally be leased out from train’s originating station to its terminating station. Page 1 of 3 सर 2022/TC(FM)/10/04-Part(1) FREIGHT MARKETING /3098142/2024 CIRCULAR No. 17_ of 2024 20.5.2 However, in cases where there is no offer received in e-Auction(s), from the originating station of the Railway, en-route Divisions may lease out parcel space from intermediate station upto the destination station, through e-Auction module provided that stoppage time of the train at that intermediate station is 05 (five) minutes or more. 20.5.3 In such cases, prior consent i.e. “No Objection Certificate’ must be obtained from the Railway in whose jurisdiction the train’s originating station is situated. 20.5.4 The concerned originating Railway must issue ‘No Objection Certificate’ (NOC) within a period of 15 (fifteen) days from the receipt of request from the intermediate Railway. 20.5.5 In case of Ordinary passenger trains, if there is no potential of leasing out parcel space from train’ originating to terminating point, Railways may lease out parcel space between any two pair of stations. 20.5.6 The intermediate Railway (i.e. contract awarding Railway) shall provide a copy of ‘Procedural Order/Working Instruction to all the concerned stations/ Divisions/ Zonal Railways where loading/unloading will be carried out, giving details inter-alia name of contractor, train number, days of operation of lease, type of lease, duration of lease, validity, date of contract, origin-destination point of lease, mode of payment, etc. 4. This issues in consultation with Coaching Directorate of Ministry of Railways. 5. Zonal Railways must ensure strict compliance of the above instructions. 6. These instructions shall come into force with immediate effect. 6.
