Please refer to Board’s letters under reference (2) wherein sanction of Competent Authority is accorded for relaxation of Demurrage and Wharfage charges, w.e.f.
22.03.2020 to 17.05.2020, as Ministry of Finance vide OM No. 18/4/2020-PPD dated
19.02.2020 has clarified that spread of corona virus should be considered as a case of natural calamity and Force Majeure Clause may be invoked.
It has been decided that the same provisions may be extended for Engine Hire Charges under EOL policy (FM 05 of 2013) Para 6.1. Accordingly, the period w.e.f.
22.03.2020 to 17.05.2020 shall be treated under Force Majeure and Engine Hire Charges shall not arise for this period. Levy of Engine Hire Charges shall be resumed from
18.05.2020, however, free time shall be relaxed to twice the applicable free time till
31.05.2020. The enhanced free time shall be applicable for the rakes placed for loading/unloading upto 31.05.2020. Thereafter, normal free time shall be applicable.
Zonal Railways may accordingly arrange for waiver of Engine Hire charges collected for the said period in the above manner. Methodology for adjustment/refund of Engine Hire Charges, if already paid by the party, may be decided by the PCCM in consultation with Associate Finance.
