Policy on Luxury Tourist Trains being operated or to be operated in association with State Tourism Corporations / IRCTC Secretary (Tourism), Ministry of Tourism, Government of India, New Delhi.
GOVERNMENT OF INDIA (Bharat Sarkar) MINISTRY OF RAILWAYS (Rail Mantralaya) (RAILWAY BOARD) No.2010/Tourism/140/2 New Delhi, dated the 18th June, 2012. The General Managers, All Indian Railways. (COMMERCIAL CIRCULAR Nai‘of 2012) Sub: Policy on Luxury Tourist Trains being operated or to be operated in association with State Tourism Corporations / IRCTC Ref: Railway Board's letter No.2010/Tourism/140/2 dated 03.08.2011. Further to Board's letters referred above regarding policy on Luxury Tourist trains being operated or to be operated in association with State Tourism Corporations / IRCTC, decisions have been taken which are as under: 1. The basic principles for calculation of haulage charges will continue to be as per Railway Board's letter No. 2010/Tourism/140/2 dated 03.08.2011. However, it will not be linked to immediate clearance of outstanding dues and would be applicable from the commencement of season 2011-12. Capital cost of bare shells and DG sets will be taken as per the vetted figures provided by ICE and forwarded by DME(PU). 2. The interest on outstanding arrears on haulage charges for the entire past period has been waived off provided the agreements between Railways and the Tourism Corporations are signed and all arrears are paid as per agreed schedule of agreement. 3. The schedule of payment of arrears by Tourism Corporations will be 1 st of July every year in equal installments, starting from 1.7.2012, so as to liquidate the arrears Within a period of 5 years for arrears more than Rs.10 Cr. (ii) Within a period of 3 years for arrears more than Rs.5 Cr. and less than Rs.10 Cr. (iii) Within a period of 2 years for arrears upto Rs.5 Cr. 4. The arrears of haulage charge will be calculated for the period prior to the rationalization of haulage charge ie. upto 2.8.2011. The arrears, if any, for the period starting from 3.8.2011, will have to be paid by the Tourism Corporations immediately, without linking to the above schedule, after notification of the rationalized haulage charges for the above period by the Zonal Railways. 5. An agreement will be entered into between the Zonal Railways and the Tourism Corporations which will clearly bring out the terms and conditions for regular / e_AA-4-161 - • - 9 arrear payments as per laid down schedule. Failure to adhere to the payment schedule could lead to discontinuance of operation of the services. No train should run without advance payment of haulage charges so that no arrears accumulate in future. CCMs of nodal railways will ensure that advance payment is made prior to run. Payment of haulage charges will be made within 15 days in advance for each trip. Interest on non-payment ofihaulage charge will be 12% instead of 18%. There will be no additional charges linked with occupancy of the train. 9. Charter trips are defined as a trip wherein the fare collected by Tourism Corporations is higher than the tariff notified and published by them for the season. The onus to inform Railways of the trip whether charter would be on the • Tourism Corporations. In case of default, suitable penalty would be imposed by Railways on Tourism Corporations. The charter trips will continue to be charged a minimum 15% mark up over haulage charge. 10. Ministry of Tourism may set up a monitoring mechanism along with Ministry of Railways to ensure that payments to Railways are streamlined and further arrears are not accumulated. 11. All the above decisions will be applicable from 3.8.2011 unless otherwise mentioned. 12. All other instructions issued earlier will continue to remain in effect, except the above amendments. 13. A further review after 3 years would be undertaken to assess the occupancy scenario based on the above.
