(COMMERCIAL CIRCULAR NO. 15 OF 2010) Sub: Appointment of Jan Sadharan Ticket Booking Sewak(JTBS). Please refer to Board's letters No.2007/TG-I/20/JTBS dated 24.1.2008(Commercial Circular No.8 of 2008) on the subject quoted above wherein detailed guidelines for appointment of JTBS have been specified. Subsequently a copy of Standard Agreement to be signed between JTBS and Zonal Railways was circulated vide Commercial Circular No.03 of2009 issued on 27.01.2009. 2. A reference has been received from Northern Railway seeking clarification whether JTBS license can be transferred in favour of legal heirs of JTBS agent after his sudden demise. Since there is no provision in the existing policy for transfer of licence in favour of any legal heir, the matter has been examined and Board has decided that the provision regarding transfer of licence in favour of legal heir of JTBS after his/her demise may be made by adding para 7.1 in JTBS policy and modifying para 7.1 of Standard Agreement as undet:- "The JTBS will not sublet, assign or transfer the rights or obligations arising out of the contract. In case of death of licencee, the licence will be transferred to his/her legal heir(s) for the unexpired period of licence by the competent authority and the legal heir(s) will also be eligible to apply for extension to the licence as per the provisions of para 7 of the policy". 3. Necessary action may be taken accordingly and receipt of letter acknowledged 4. This issues with the concurrence of Finance Directorate of Ministry of Railways. DA: As above.
