This is only a FINANCIAL upgradation and not a promotion. This also does NOT involve creation of new posts. Since BOTH these criteria are satisfied, THERE 15 NO RESERVATION OF POSTS as per the HONOURABLE SUPREME COURT OF INDIA verdict CIVIL APPEAL NOS.5286-87 OF 2005 BSNL Vs Santhakumari veluswamy and co with CIVIL APPEAL NOS.3405, 4542, 4543, 4544, 4545 and 4546 of 2006. The Hon Supreme Court has judged that reservation is NOT to be implemented as per the directives set in , copy attached . This Upgradation is ONLY Financial in nature giving no ADDITIONAL RESPONSIBILITY NOR CREATION OF ADDITIONAL POSTS . INFACT posts are surrendered at the lower grade. In the light of the above, it is most pertinent that THIS MEMORANDUM if implemented in an Office Order and upgradation given, it will be aGROSS INJUSTICE and MISCARRIAGE OF JUSTICE to the signatories below. IT IS ALSO MADE KNOWN THAT IT INVOKES THE CLAUSE OF CONTEMPT OF COURT AN AS MUCH AS THE FACTS ARE CONCERNED.
